Car Accidents in Texas
Motor vehicle accidents resulting in injuries take place approximately every two minutes in Texas. These incidents add up to hundreds of thousands of crashes every year, sending victims to hospitals in our state. Unfortunately, there are many instances where victims suffer injuries that affect their lives indefinitely. Internal organ injuries, spinal cord injuries, and traumatic brain injuries can all require extensive medical treatment.
In many cases, victims suffer these and other severe injuries due to the negligence of other drivers. After being hurt in a car crash, victims have the ability to file personal injury claims to recover compensation. In Texas, the legal principle of comparative negligence plays a crucial role in personal injury claims arising from car crashes. However, the state follows a modified version of comparative negligence, specifically the 51% rule. This means that an injured party can only seek compensation if their degree of fault in the accident is less than 51%.
If a court determines that the injured party is 51% or more at fault, they are barred from recovering damages. To ensure you have the best chance of getting justice after your accident, it is imperative that you seek legal representation from a dedicated San Antonio car accident lawyer. Your attorney will be able to prove your case against the defendant and help you maximize the compensation you are able to recover for your medical costs, vehicle repairs, lost wages, and more.
